Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (“User” or “you”) and AIWF (AI With Features), operating as Scout (“we,” “our,” or “us”), governing your use of the Scout motorcycle ride companion application (the “Service”).

By creating an account, signing in, or otherwise accessing or using Scout, you confirm that:

• You are at least 18 years old, or at least 13 years old with parental or guardian consent
• You have the legal capacity to enter into these Terms
• You hold a valid licence to ride a motorcycle in your jurisdiction, if using ride-tracking features

2. Description of Service

Scout is a motorcycle ride companion application that provides:

• Real-time GPS ride tracking with speed, distance, and route recording
• Ride history storage, statistics, and replay functionality
• Gamification features including XP points, achievements, and rider levels
• An AI-powered ride assistant for information and guidance
• Cloud sync and backup of ride data via Firebase
• Map-based navigation and ride visualisation

The Service is provided for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. User Accounts

3.1 Registration

You must create an account to use most features of Scout. You may register using a valid Google account. You agree to provide accurate, current, and complete information and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at mohitdevelopment48@gmail.com if you suspect unauthorised access to your account.

3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, exploit gamification systems, or misrepresent your identity is prohibited and may result in account termination.

4. User Responsibilities & Conduct

4.1 Safe Riding

You agree that:

• You will only use Scout’s ride-tracking features while complying with all applicable traffic laws and regulations
• You will not interact with the app screen while the vehicle is in motion
• You will not use Scout as a substitute for professional navigation or safety equipment
• You accept full responsibility for your safety and the safety of others while riding

4.2 Accurate Information

You agree to provide accurate profile information and not misrepresent your identity, riding history, or achievements. Artificially manipulating ride data, XP, or achievements through technical means or deception is prohibited.

4.3 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated scripts, bots, or tools to interact with the Service
• Attempt to gain unauthorised access to our systems or other users’ data
• Upload or transmit malicious code, viruses, or harmful content
• Harass, abuse, or harm other users of the Service
• Use the Service in a manner that could damage, disable, or impair the Service

5. Intellectual Property

5.1 Our Content

The Scout app, including its name, logo, design, code, features, graphics, and content (excluding user-generated data), is owned by AIWF / Scout and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app for personal purposes in accordance with these Terms.

5.2 Your Content

You retain ownership of the ride data, profile information, and other content you create through the app (“Your Content”). By using the Service, you grant us a limited licence to store, process, and display Your Content as necessary to provide the Service.

5.3 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without restriction or compensation to you.

6. Privacy

Your use of Scout is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or free of viruses
• Warranties regarding the accuracy, reliability, or completeness of GPS data, ride statistics, or AI responses

GPS accuracy and ride data are dependent on device hardware and external factors. We do not guarantee precise tracking data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AIWF / Scout, its directors, employees, affiliates, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or goodwill
• Personal injury, property damage, or death arising from or in connection with your use of the Service or participation in any ride activity
• Errors or inaccuracies in ride data, GPS tracking, or AI assistant responses
• Service interruptions, downtime, or loss of data

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or INR 1,000 (whichever is greater).

9. Indemnification

You agree to indemnify, defend, and hold harmless AIWF / Scout and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any ride or driving activity you undertake while using Scout

10. Termination

10.1 Termination by You

You may stop using the Service at any time. You may delete your account through the app’s Profile settings or by contacting us at mohitdevelopment48@gmail.com.

10.2 Termination by Us

We reserve the right to suspend or permanently terminate your account and access to the Service, with or without notice, if:

• You violate these Terms or our policies
• We are required to do so by law
• We discontinue the Service
• Your account has been inactive for an extended period

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and governing law.

11. Changes to Terms

We may revise these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new “Last Updated” date
• Sending an in-app notification for significant changes

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

13. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
• Language: These Terms are written in English. In the event of any conflict between a translated version and the English original, the English version prevails.
